Zahrada m\u016f\u017ee b\u00fdt v osobn\u00edm vlastnictv\u00ed \u2013 tedy bude st\u00e1t na pozemku vlastn\u00edka. Nebo tak\u00e9 m\u016f\u017ee b\u00fdt v zahr\u00e1dk\u00e1\u0159sk\u00e9 kolonii. Tam jsou vlastnick\u00e9 vztahy trochu jin\u00e9, a nep\u016fjde vlastn\u011b o koupi, ale o podn\u00e1jem. To v\u0161ak neznamen\u00e1, \u017ee st\u00e1vaj\u00edc\u00edmu zahr\u00e1dk\u00e1\u0159i nebudete nic platit.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Co si pohl\u00eddat, pokud jde o zahradu v osobn\u00edm vlastnictv\u00ed<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Jestli\u017ee zahrada stoj\u00ed na pozemku vlastn\u00edka, je to samoz\u0159ejm\u011b v\u00fdhodn\u00e1 koup\u011b. Vlastn\u00edk se \u0159\u00edd\u00ed pouze sv\u00fdm \u00fasudkem, co chce v zahrad\u011b p\u011bstovat, chovat, \u010di pro\u017e\u00edvat. Jen samoz\u0159ejm\u011b je t\u0159eba d\u00e1t pozor, pokud bude prod\u00e1vaj\u00edc\u00ed tvrdit, \u017ee v budoucnu m\u016f\u017ee doj\u00edt k p\u0159evodu zahrady na stavebn\u00ed pozemek. Jako v mnoha jin\u00fdch p\u0159\u00edpadech, i zde se vyplat\u00ed zaj\u00edt na obecn\u00ed \u00fa\u0159ad \u010di p\u0159\u00edslu\u0161n\u00fd stavebn\u00ed \u00fa\u0159ad a nahl\u00e9dnout p\u0159edev\u0161\u00edm do schv\u00e1len\u00e9ho \u00fazemn\u00edho pl\u00e1nu. Nemus\u00edte \u0159e\u0161it zm\u011bnu druhu pozemku a prost\u011b si u\u017eijete zahradu jako takovou. Nicm\u00e9n\u011b na v\u011bt\u0161ina zahrad n\u011bjak\u00e1 stavba stoj\u00ed. Nap\u0159\u00edklad k\u016flna na n\u00e1\u0159ad\u00ed, alt\u00e1nek, zahradn\u00ed chatka. V tom p\u0159\u00edpad\u011b je t\u0159eba zjistit, zda je zanesena v katastru nemovitost\u00ed. Zahradn\u00ed domek do 25 m2 zastav\u011bn\u00e9 plochy nevy\u017eaduje dle stavebn\u00edho z\u00e1kona stavebn\u00ed povolen\u00ed ani ohl\u00e1\u0161en\u00ed, a nen\u00ed tedy p\u0159edm\u011btem z\u00e1pisu do katastru. Ov\u0161em ta \u010d\u00e1st zahrady, na n\u00ed\u017e stavba stoj\u00ed, by nem\u011bla b\u00fdt ozna\u010dena jako zahrada, ale jako \u201eostatn\u00ed plocha\u201c. Stavby o rozloze nad 25 m2 vy\u017eaduj\u00ed rozhodnut\u00ed stavebn\u00edho \u00fa\u0159adu, a tud\u00ed\u017e se tak\u00e9 zapisuj\u00ed po dokon\u010den\u00ed do katastru nemovitost\u00ed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Zahrada v zahr\u00e1dk\u00e1\u0159sk\u00e9 kolonii<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">V tomto prostoru nejde o \u010dist\u00fd prodej zahrady, proto\u017ee zahr\u00e1dk\u00e1\u0159sk\u00e9 kolonie b\u00fdvaj\u00ed v jin\u00e9m re\u017eimu. V\u011bt\u0161inou je s vlastn\u00edkem pozemku (\u010dasto obec, m\u011bsto) uzav\u0159ena n\u00e1jemn\u00ed smlouva jedn\u00edm subjektem. B\u00fdv\u00e1 to nap\u0159\u00edklad ob\u010dansk\u00e9 sdru\u017een\u00ed, zahr\u00e1dk\u00e1\u0159sk\u00fd spolek a podobn\u011b. To potom sv\u00fdm \u010dlen\u016fm zahr\u00e1dky poskytuje na z\u00e1klad\u011b podn\u00e1jemn\u00ed smlouvy. Zde je tedy t\u0159eba ohl\u00eddat si v\u00edce v\u011bc\u00ed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Nejprve si zjist\u011bte, kdo je vlastn\u00edkem pozemku, na n\u011bm\u017e se zahrada nach\u00e1z\u00ed. Informujte se, na jak dlouho m\u00e1 zahr\u00e1dk\u00e1\u0159sk\u00e9 sdru\u017een\u00ed podepsanou n\u00e1jemn\u00ed smlouvu. V\u017edy je v\u011bt\u0161\u00ed jistotou smlouva na dobu ur\u010ditou, podepsan\u00e1 ov\u0161em na v\u00edce ne\u017e deset let. Smlouva na dobu neur\u010ditou m\u00e1 v\u017edy v\u00fdpov\u011bdn\u00ed lh\u016ftu, v p\u0159\u00edpad\u011b zahr\u00e1dek \u010dasto se lh\u016ftou jeden rok.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Projd\u011bte si \u0159\u00e1d, kter\u00fd upravuje chov\u00e1n\u00ed v zahr\u00e1dk\u00e1\u0159sk\u00e9 kolonii. Uzav\u0159en\u00ed n\u00e1jmu m\u016f\u017ee b\u00fdt podm\u00edn\u011bno \u010dlenstv\u00edm ve sdru\u017een\u00ed, kter\u00e9 m\u00e1 kolonii v pron\u00e1jmu. Pokud tomu tak je, z\u0159ejm\u011b je t\u0159eba hradit \u010dlensk\u00e9 poplatky.
