Ten v\u0161ak m\u00e1 uzav\u0159enou smlouvu o zprost\u0159edkov\u00e1n\u00ed s realitn\u00ed kancel\u00e1\u0159\u00ed. N\u00e1le\u017e\u00ed j\u00ed provize, a v jak\u00e9 v\u00fd\u0161i? M\u016f\u017ee se tak\u00e9 st\u00e1t, \u017ee smlouva o zprost\u0159edkov\u00e1n\u00ed bude ukon\u010dena a n\u011bkolik m\u011bs\u00edc\u016f pot\u00e9 se objev\u00ed z\u00e1jemce, s n\u00edm\u017e prod\u00e1vaj\u00edc\u00ed uzav\u0159e kupn\u00ed smlouvu. M\u00e1 i v tomto p\u0159\u00edpad\u011b realitn\u00ed kancel\u00e1\u0159 n\u00e1rok na provizi?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Provize po ukon\u010den\u00ed zprost\u0159edkovatelsk\u00e9 smlouvy<\/strong><br>P\u0159\u00edklad: Prod\u00e1vaj\u00edc\u00ed uzav\u0159el smlouvu o zprost\u0159edkov\u00e1n\u00ed s realitn\u00ed kancel\u00e1\u0159\u00ed, v n\u00ed\u017e se zav\u00e1zal, \u017ee uhrad\u00ed provizi i v p\u0159\u00edpad\u011b, kdy\u017e uzav\u0159e do jednoho roku od skon\u010den\u00ed platnosti zprost\u0159edkovatelsk\u00e9 smlouvy kupn\u00ed smlouvu se z\u00e1jemcem, kter\u00e9ho p\u0159ivedla realitn\u00ed kancel\u00e1\u0159. Nemovitost se v \u010dase platnosti smlouvy neprodala a prod\u00e1vaj\u00edc\u00ed se rozhodl smlouvu neprodlou\u017eit. V dal\u0161\u00edm obdob\u00ed nab\u00edzel nemovitost k prodeji s\u00e1m. P\u016fl roku nato p\u0159i\u0161el na prohl\u00eddku jeden ze z\u00e1jemc\u016f, kter\u00fd byl na prohl\u00eddce ji\u017e s realitn\u00ed kancel\u00e1\u0159\u00ed. Tentokr\u00e1t se na prodeji dohodli a byla uzav\u0159ena kupn\u00ed smlouva. Prod\u00e1vaj\u00edc\u00ed pot\u00e9 dostal v\u00fdzvu od realitn\u00ed kancel\u00e1\u0159e, aby uhradil provizi za zprost\u0159edkov\u00e1n\u00ed prodeje nemovitosti. M\u00e1 ji vyplatit?<br>Odborn\u00edci v oblasti ob\u010dansk\u00e9ho pr\u00e1va odpov\u00eddaj\u00ed, \u017ee ano. Pokud opravdu jde o z\u00e1jemce, kter\u00e9ho p\u016fvodn\u011b p\u0159ivedla realitn\u00ed kancel\u00e1\u0159, provize j\u00ed n\u00e1le\u017e\u00ed.<br><br><strong>Co \u0159\u00edk\u00e1 ob\u010dansk\u00fd z\u00e1kon\u00edk<\/strong><br>Paragraf 2454 z\u00e1kona \u010d. 89\/2012 Sb., ob\u010dansk\u00fd z\u00e1kon, stanov\u00ed: &#8222;Pr\u00e1vu zprost\u0159edkovatele na provizi nen\u00ed na \u00fajmu, byla-li smlouva, k n\u00ed\u017e se vztahovala \u010dinnost zprost\u0159edkovatele, uzav\u0159ena nebo spln\u011bna a\u017e po z\u00e1niku z\u00e1vazku ze zprost\u0159edkovatelsk\u00e9 smlouvy.&#8220;<br><br>K tomu je mo\u017eno zm\u00ednit je\u0161t\u011b \u00a7 2447 odst. 2, kter\u00fd uv\u00e1d\u00ed: &#8222;Bylo-li ujedn\u00e1no, \u017ee zprost\u0159edkovatel pro z\u00e1jemce obstar\u00e1 p\u0159\u00edle\u017eitost uzav\u0159\u00edt s t\u0159et\u00ed osobou smlouvu s ur\u010dit\u00fdm obsahem, je provize splatn\u00e1 ji\u017e obstar\u00e1n\u00edm p\u0159\u00edle\u017eitosti.&#8220;<br><br>Nelze tedy tzv. obej\u00edt realitn\u00ed kancel\u00e1\u0159 a sjednat si se z\u00e1jemcem, kter\u00e9 z\u00edskala, kupn\u00ed smlouvu bez jej\u00edho v\u011bdom\u00ed nebo po skon\u010den\u00ed zprost\u0159edkovatelsk\u00e9 smlouvy.<br><br>Na druhou stranu je t\u0159eba, aby realitn\u00ed kancel\u00e1\u0159 prok\u00e1zala, \u017ee tato osoba byla na prohl\u00eddce, p\u0159\u00edpadn\u011b byla s realitn\u00ed kancel\u00e1\u0159\u00ed v jin\u00e9m kontaktu a m\u011bla o tuto nemovitost z\u00e1jem. Prod\u00e1vaj\u00edc\u00ed se tud\u00ed\u017e nemus\u00ed ob\u00e1vat, \u017ee by makl\u00e9\u0159 neeticky nap\u0159\u00edklad zjistil jm\u00e9no kupuj\u00edc\u00edho v katastru nemovitost\u00ed a \u017e\u00e1dal provizi, ani\u017e by s kupuj\u00edc\u00edm vstoupil v jak\u00e9koli obchodn\u00ed jedn\u00e1n\u00ed.<br><br><strong>Kdy\u017e z\u00e1jemce nezprost\u0159edkuje makl\u00e9\u0159<\/strong><br>M\u016f\u017ee se v\u0161ak st\u00e1t, \u017ee z\u00e1jemce o koupi nemovitosti p\u0159ijde, ani\u017e by v\u011bd\u011bl, \u017ee prod\u00e1vaj\u00edc\u00ed m\u00e1 uzav\u0159enou zprost\u0159edkovatelskou smlouvu s realitn\u00ed kancel\u00e1\u0159\u00ed. V dob\u011b trv\u00e1n\u00ed smlouvy samoz\u0159ejm\u011b realitn\u00ed kancel\u00e1\u0159 jedn\u00e1 s mnoha z\u00e1jemci, realizuje prohl\u00eddky, nemovitost inzeruje a vyv\u00edj\u00ed dal\u0161\u00ed \u010dinnosti sm\u011b\u0159uj\u00edc\u00ed k nalezen\u00ed vhodn\u00e9ho kupuj\u00edc\u00edho.<br><br>P\u0159esto se jej\u00ed snaha mine \u00fa\u010dinkem, respektive kupuj\u00edc\u00ed se objev\u00ed odjinud. M\u016f\u017ee to b\u00fdt t\u0159eba soused nebo p\u0159\u00edbuzn\u00fd, jemu\u017e se prod\u00e1vaj\u00edc\u00ed sv\u011b\u0159il se snahou nemovitost prodat. Jak d\u00e1le postupovat, ani\u017e by prod\u00e1vaj\u00edc\u00ed poru\u0161il z\u00e1vazky vypl\u00fdvaj\u00edc\u00ed ze zprost\u0159edkovatelsk\u00e9 smlouvy?<br><br>Podle osloven\u00ed n\u011bkolika realitn\u00edch makl\u00e9\u0159\u016f je korektn\u00ed, pokud prod\u00e1vaj\u00edc\u00ed informuje z\u00e1jemce, \u017ee m\u00e1 uzav\u0159enou zprost\u0159edkovatelskou smlouvu a nech\u00e1 makl\u00e9\u0159e, aby obchod dokon\u010dil. To znamen\u00e1, \u017ee realitn\u00ed kancel\u00e1\u0159 sice nenajde z\u00e1jemce, ale odvede dal\u0161\u00ed pr\u00e1ci, jako je zpracov\u00e1n\u00ed kupn\u00ed smlouvy, \u00faschova kupn\u00ed \u010d\u00e1stky, pod\u00e1n\u00ed na katastr a dal\u0161\u00ed. V tomto p\u0159\u00edpad\u011b m\u00e1 realitn\u00ed kancel\u00e1\u0159 n\u00e1rok na provizi.<br><br>Pokud tedy realitn\u00ed kancel\u00e1\u0159 kon\u00e1 \u0159\u00e1dn\u011b a vyv\u00edj\u00ed ve\u0161kerou \u010dinnost spojenou s nab\u00edzen\u00edm a prodeje nemovitosti, m\u00e1 na provizi n\u00e1rok, a to i po ukon\u010den\u00ed smlouvy. Tento n\u00e1rok je v\u0161ak nutno \u010dasov\u011b omezit, v\u011bt\u0161inou jde maxim\u00e1ln\u011b o 1 rok.
