Pronaj\u00edmatel nem\u016f\u017ee zv\u00fd\u0161it n\u00e1jemn\u00e9 libovoln\u011b. Ob\u010dansk\u00fd z\u00e1kon\u00edk specifikuje podm\u00ednky, kdy je mo\u017en\u00e9 tak u\u010dinit a&nbsp;za jak\u00fdch podm\u00ednek.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>N\u00e1jemn\u00ed smlouvy na dobu neur\u010ditou<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">U&nbsp;smluv na dobu neur\u010ditou lze zv\u00fd\u0161it n\u00e1jemn\u00e9 tak, aby se rovnalo v\u00fd\u0161i obvykl\u00e9ho n\u00e1jemn\u00e9ho v&nbsp;okol\u00ed v&nbsp;dan\u00e9m obdob\u00ed. Pokud tedy je n\u00e1jemn\u00e9 stanoveno ni\u017e\u0161\u00ed ne\u017e u&nbsp;srovnateln\u00fdch byt\u016f v&nbsp;dan\u00e9 lokalit\u011b, m\u016f\u017ee pronaj\u00edmatel jednou za rok navrhnout zv\u00fd\u0161en\u00ed. N\u00e1vrh mus\u00ed m\u00edt p\u00edsemnou podobu a&nbsp;nav\u00fd\u0161en\u00ed nesm\u00ed p\u0159ekro\u010dit 20 procent za posledn\u00ed t\u0159i roky. Pronaj\u00edmatel mus\u00ed prok\u00e1zat, \u017ee v&nbsp;dan\u00e9 lokalit\u011b je b\u011b\u017en\u00e9 vy\u0161\u0161\u00ed n\u00e1jemn\u00e9. To mus\u00ed dolo\u017eit bu\u010f znaleck\u00fdm posudkem, nebo nap\u0159\u00edklad minim\u00e1ln\u011b t\u0159emi n\u00e1jemn\u00edmi smlouvami z&nbsp;jin\u00fdch dom\u016f v&nbsp;okol\u00ed. Jestli\u017ee n\u00e1jemce do dvou m\u011bs\u00edc\u016f neodsouhlas\u00ed jeho n\u00e1vrh, m\u016f\u017ee se pronaj\u00edmatel do dal\u0161\u00edch t\u0159\u00ed m\u011bs\u00edc\u016f dom\u00e1hat zv\u00fd\u0161en\u00ed u&nbsp;soudu. V&nbsp;soudn\u00edm \u0159\u00edzen\u00ed pak m\u016f\u017ee b\u00fdt na n\u00e1vrh pronaj\u00edmatele i&nbsp;p\u0159ekro\u010den 20% limit, a&nbsp;to a\u017e do v\u00fd\u0161e obvykl\u00e9ho n\u00e1jemn\u00e9ho. Pronaj\u00edmatel m\u016f\u017ee tak\u00e9 zv\u00fd\u0161it n\u00e1jemn\u00e9, pokud byly v&nbsp;byt\u011b, resp. v&nbsp;dom\u011b, provedeny stavebn\u00ed \u00fapravy, kter\u00e9 trvale zv\u00fd\u0161ily u\u017eitnou hodnotu bytu, podm\u00ednky bydlen\u00ed v&nbsp;dom\u011b nebo byly provedeny za \u00fa\u010delem \u00faspory energie a&nbsp;vody. N\u00e1jemn\u00e9 m\u016f\u017ee b\u00fdt zv\u00fd\u0161eno a\u017e o&nbsp;10 % \u00fa\u010deln\u011b vynalo\u017een\u00fdch n\u00e1klad\u016f. Jak konstatuje spot\u0159ebitelsk\u00fd magaz\u00edn dTest, souhlas\u00ed-li s&nbsp;n\u00e1vrhem na takov\u00e9 zv\u00fd\u0161en\u00ed n\u00e1jemn\u00e9ho alespo\u0148 n\u00e1jemci dvou t\u0159etin byt\u016f v&nbsp;dom\u011b, plat\u00ed dle ob\u010dansk\u00e9ho z\u00e1kon\u00edku zv\u00fd\u0161en\u00e9 n\u00e1jemn\u00e9 i&nbsp;pro ostatn\u00ed n\u00e1jemce. Pokud se pronaj\u00edmateli nepoda\u0159\u00ed dohodnout se s&nbsp;n\u00e1jemci, m\u016f\u017ee navrhnout nav\u00fd\u0161en\u00ed o&nbsp;3,5 procenta vynalo\u017een\u00fdch n\u00e1klad\u016f ro\u010dn\u011b.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Smlouva na dobu ur\u010ditou<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">N\u011bkte\u0159\u00ed pronaj\u00edmatel\u00e9 sjedn\u00e1vaj\u00ed n\u00e1jemn\u00ed smlouvy na dobu ur\u010ditou, a&nbsp;to na kr\u00e1tkou dobu jednoho \u010di dvou let. V&nbsp;tomto p\u0159\u00edpad\u011b maj\u00ed voln\u00e9 ruce, proto\u017ee limity pro zv\u00fd\u0161en\u00ed n\u00e1jemn\u00e9ho plat\u00ed pouze u&nbsp;smluv na dobu neur\u010ditou. A&nbsp;tak pokud m\u00e1 n\u00e1jemce z\u00e1jem pokra\u010dovat v&nbsp;n\u00e1jmu, mus\u00ed p\u0159i sjedn\u00e1n\u00ed nov\u00e9 n\u00e1jemn\u00ed smlouvy akceptovat jak\u00e9koli zv\u00fd\u0161en\u00ed. Pokud nebude souhlasit, n\u00e1jem skon\u010d\u00ed uplynut\u00edm doby, na kterou byla smlouva sjedn\u00e1na.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Infla\u010dn\u00ed dolo\u017eka<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">V&nbsp;n\u00e1jemn\u00ed smlouv\u011b b\u00fdv\u00e1 \u010dasto zvy\u0161ov\u00e1n\u00ed n\u00e1jemn\u00e9ho upraveno tzv. infla\u010dn\u00ed dolo\u017ekou. Toto ustanoven\u00ed uv\u00e1d\u00ed, \u017ee n\u00e1jemn\u00e9 se zvy\u0161uje podle m\u00edry inflace. Je v\u0161ak t\u0159eba m\u00edt k&nbsp;tomu smluvn\u011b zakotveny dal\u0161\u00ed \u00fadaje. Prvn\u00edm z&nbsp;nich je, kterou konkr\u00e9tn\u00ed inflac\u00ed se bude navy\u0161ov\u00e1n\u00ed n\u00e1jmu \u0159\u00eddit. V\u011bt\u0161inou se m\u00edra inflace vyjad\u0159uje pomoc\u00ed indexu spot\u0159ebitelsk\u00fdch cen, kter\u00fd zve\u0159ej\u0148uje \u010cesk\u00fd statistick\u00fd \u00fa\u0159ad. Ale mohou to b\u00fdt i&nbsp;jin\u00e9 ukazatele, proto je t\u0159eba je ve smlouv\u011b p\u0159esn\u011b stanovit. D\u00e1le je t\u0159eba ur\u010dit datum, ke kter\u00e9mu se n\u00e1jemn\u00e9 bude zvy\u0161ovat. V\u011bt\u0161inou to b\u00fdv\u00e1 prvn\u00ed leden, ale m\u016f\u017ee to b\u00fdt i&nbsp;nap\u0159\u00edklad datum uzav\u0159en\u00ed n\u00e1jemn\u00ed smlouvy \u010di jin\u00fd term\u00edn. S&nbsp;infla\u010dn\u00ed dolo\u017ekou doch\u00e1z\u00ed ke zv\u00fd\u0161en\u00ed n\u00e1jemn\u00e9ho automaticky. A&nbsp;tak pronaj\u00edmatel sice nemus\u00ed n\u00e1jemce k&nbsp;platb\u011b zv\u00fd\u0161en\u00e9ho n\u00e1jemn\u00e9ho vyzvat, nicm\u00e9n\u011b doporu\u010duje se, aby tak u\u010dinil. Je mo\u017en\u00e9 tak p\u0159edej\u00edt r\u016fzn\u00fdm nedorozum\u011bn\u00edm, \u0161patn\u00fdm v\u00fdpo\u010dt\u016fm a&nbsp;podobn\u011b.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Slu\u017eby nejsou n\u00e1jemn\u00e9<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">V\u011bt\u0161ina n\u00e1jemc\u016f je zvykl\u00e1 \u0159\u00edkat \u201en\u00e1jem\u201c v\u0161em poplatk\u016fm, kter\u00e9 odv\u00e1d\u00ed majiteli domu. Tato platba se v\u0161ak d\u011bl\u00ed na dv\u011b \u010d\u00e1sti. Jednou z\u00a0nich je faktick\u00e9 n\u00e1jemn\u00e9, druhou jsou \u00fahrady za slu\u017eby, jako je odvoz odpadu, \u00faklid, pom\u011brn\u00e1 \u010d\u00e1st energi\u00ed za spole\u010dn\u00e9 prostory, p\u0159\u00edpadn\u011b pou\u017e\u00edv\u00e1n\u00ed v\u00fdtahu a\u00a0dal\u0161\u00ed. Platby za slu\u017eby by m\u011bly odpov\u00eddat skute\u010dn\u00fdm n\u00e1klad\u016fm rozpo\u010d\u00edtan\u00fdm na byty a\u00a0osoby, a\u00a0tak se jich infla\u010dn\u00ed dolo\u017eka net\u00fdk\u00e1. Tyto platby se zvy\u0161uj\u00ed pouze tehdy, pokud jsou zv\u00fd\u0161eny od dodavatel\u016f slu\u017eeb. Pravideln\u00e9 zvy\u0161ov\u00e1n\u00ed n\u00e1jemn\u00e9ho o\u00a0fixn\u00ed \u010d\u00e1stku nebo zvy\u0161ov\u00e1n\u00ed formou infla\u010dn\u00ed dolo\u017eky se doporu\u010duje sjednat v\u00a0n\u00e1jemn\u00ed smlouv\u011b. Smlouva v\u0161ak tak\u00e9 m\u016f\u017ee zcela zvy\u0161ov\u00e1n\u00ed n\u00e1jemn\u00e9ho vylou\u010dit.
