Uv\u00e1d\u00ed pr\u00e1va a povinnosti pronaj\u00edmatele, ale i pr\u00e1va n\u00e1jemce, \u010di podn\u00e1jemce. Mimo ob\u010dansk\u00e9ho z\u00e1kon\u00edku \u0159e\u0161\u00ed pr\u00e1va a povinnosti obou stran tak\u00e9 na\u0159\u00edzen\u00ed vl\u00e1dy \u010d. 308\/2015 Sb., o vymezen\u00ed pojm\u016f b\u011b\u017en\u00e1 \u00fadr\u017eba a drobn\u00e9 opravy souvisej\u00edc\u00ed s n\u00e1jmem bytu. Ka\u017edop\u00e1dn\u011b jde v\u017edy o obchodn\u00ed vztah, a i kdy\u017e lze p\u0159edpokl\u00e1dat, \u017ee ob\u011b strany jednaj\u00ed seri\u00f3zn\u011b, je t\u0159eba, aby si pronaj\u00edmatel i n\u00e1jemce zjistili pot\u0159ebn\u00e9 informace o druh\u00e9 stran\u011b, pokud je ten nep\u0159edlo\u017e\u00ed s\u00e1m.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Pronaj\u00edmatel jako fyzick\u00e1 osoba<\/strong><br>\u010cast\u00fdm vlastn\u00edkem bytov\u00e9ho domu je fyzick\u00e1 osoba. Ta je zaps\u00e1na jako vlastn\u00edk nemovitosti v katastru nemovitost\u00ed. Pokud je d\u016fm ve spoluvlastnictv\u00ed v\u00edce osob, mus\u00ed b\u00fdt v katastru zaps\u00e1ny v\u0161echny a jejich pod\u00edl. V tomto p\u0159\u00edpad\u011b by v\u00e1s m\u011bl ten z vlastn\u00edk\u016f, kter\u00fd s potenci\u00e1ln\u00edmi n\u00e1jemci jedn\u00e1, informovat, zda a na jak\u00e9m z\u00e1klad\u011b (nap\u0159. pln\u00e1 moc) m\u00e1 pr\u00e1vo zastupovat spoluvlastn\u00edky a pronaj\u00edmat byty, resp. uzav\u00edrat n\u00e1jemn\u00ed smlouvy. Fyzick\u00e1 osoba vlastn\u00edc\u00ed byt \u010di d\u016fm, kter\u00fd pronaj\u00edm\u00e1, nemus\u00ed m\u00edt \u017eivnostensk\u00fd list. P\u0159\u00edjmy, resp. zisk z pron\u00e1jmu pak d\u00e1v\u00e1 do da\u0148ov\u00e9ho p\u0159izn\u00e1n\u00ed. Stejn\u00e9 je to s vlastnictv\u00edm bytu ve sdru\u017een\u00ed vlastn\u00edk\u016f jednotek.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Vlastn\u00edkem je bytov\u00e9 dru\u017estvo<\/strong><br>Dru\u017estevn\u00ed byty nevlastn\u00ed dru\u017estevn\u00edci, ti maj\u00ed v dru\u017estvu \u201epouze\u201c dru\u017estevn\u00ed pod\u00edl, jeho\u017e sou\u010d\u00e1st\u00ed je tak\u00e9 pr\u00e1vo n\u00e1jmu bytu. V\u00fdhodou tohoto typu n\u00e1jmu je, \u017ee bytov\u00e9 dru\u017estvo dle z\u00e1kona nesm\u00ed vyd\u011bl\u00e1vat pen\u00edze, tak\u017ee pron\u00e1jem je levn\u011bj\u0161\u00ed. Ov\u0161em pouze pro dru\u017estevn\u00edka. Pokud si budete pronaj\u00edmat dru\u017estevn\u00ed byt, je t\u0159eba zjistit si tak\u00e9 pot\u0159ebn\u00e9 informace. Byt m\u016f\u017ee pronaj\u00edmat dru\u017estvo, pokud k n\u011bmu nem\u00e1 pr\u00e1vo \u017e\u00e1dn\u00fd z dru\u017estevn\u00edk\u016f. To se m\u016f\u017ee st\u00e1t nap\u0159\u00edklad tehdy, kdy\u017e je n\u011bkter\u00fd z nich pro hrub\u00e9 poru\u0161en\u00ed stanov z dru\u017estva vylou\u010den.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Dru\u017estvo se na \u010dlensk\u00e9 sch\u016fzi dohodne, \u017ee si byt ponech\u00e1 a pronajme jej ne\u010dlenovi dru\u017estva \u2013 v tomto p\u0159\u00edpad\u011b u\u017e za tr\u017en\u00ed, nikoli tedy sn\u00ed\u017een\u00fd n\u00e1jem. Jestli\u017ee byt pronaj\u00edm\u00e1 dru\u017estevn\u00edk, jedn\u00e1 se o podn\u00e1jem, nikoli pron\u00e1jem. S podn\u00e1jmem mus\u00ed souhlasit dru\u017estvo. Souhlas mus\u00ed m\u00edt p\u00edsemnou formu nebo m\u016f\u017ee b\u00fdt tato mo\u017enost zahrnuta ve stanov\u00e1ch, v\u010detn\u011b podm\u00ednek, kter\u00fd mus\u00ed \u010dlen dru\u017estva splnit. V\u00fdjimkou nen\u00ed ani pravideln\u00fd poplatek za to, \u017ee sm\u00ed byt pronaj\u00edmat.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Omezen\u00ed pron\u00e1jmu v p\u0159\u00edpad\u011b rodinn\u00e9 dom\u00e1cnosti<\/strong><br>Rodinn\u00e1 dom\u00e1cnost m\u00e1 v p\u0159\u00edpad\u011b pron\u00e1jmu bytu tu nejvy\u0161\u0161\u00ed ochranu. Pronaj\u00edmatel mus\u00ed respektovat tuto skute\u010dnost nejen p\u0159i uzav\u00edr\u00e1n\u00ed n\u00e1jemn\u00ed smlouvy, ale p\u0159edev\u0161\u00edm p\u0159i jej\u00edm ukon\u010den\u00ed. B\u011b\u017en\u00fdm p\u0159\u00edpadem je, \u017ee uzav\u0159e smlouvu s n\u00e1jemcem, kter\u00fd se v pr\u016fb\u011bhu bydlen\u00ed v dan\u00e9 nemovitosti vd\u00e1\/o\u017een\u00ed. Kdy\u017e se k n\u011bmu partner p\u0159ist\u011bhuje, vznikne v byt\u011b rodinn\u00e1 dom\u00e1cnost. V tomto p\u0159\u00edpad\u011b pak n\u00e1jemn\u00ed pr\u00e1vo k dan\u00e9mu bytu automaticky vznikne i jeho man\u017eelce\/man\u017eelovi. Co\u017e znamen\u00e1, \u017ee maj\u00ed oba pr\u00e1vo bydlet, ale z\u00e1rove\u0148 i oba povinnost platit n\u00e1jemn\u00e9.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Hodl\u00e1-li p\u016fvodn\u00ed n\u00e1jemn\u00edk byt, v n\u011bm\u017e se nach\u00e1z\u00ed jeho rodinn\u00e1 dom\u00e1cnost, opustit a n\u00e1jemn\u00ed smlouvu ukon\u010dit, nesm\u00ed tak u\u010dinit bez souhlasu druh\u00e9ho z man\u017eel\u016f. Jen\u017ee pokud t\u0159eba jeho opu\u0161t\u011bn\u00ed dom\u00e1cnosti neprob\u00edh\u00e1 v klidn\u00e9 atmosf\u00e9\u0159e, m\u016f\u017ee n\u00e1jemce pronaj\u00edmatele uv\u00e9st v omyl a sd\u011blit mu, \u017ee n\u00e1jem ukon\u010duje i za druh\u00e9ho partnera. V praxi tak m\u016f\u017ee nastat situace, \u017ee pronaj\u00edmatel se nesezn\u00e1m\u00ed se stanoviskem druh\u00e9ho z man\u017eel\u016f a v dobr\u00e9 v\u00ed\u0159e s p\u016fvodn\u00edm n\u00e1jemcem uzav\u0159e dohodu o ukon\u010den\u00ed n\u00e1jemn\u00ed smlouvy. Jej\u00ed platnost v\u0161ak m\u016f\u017ee b\u00fdt \u00fasp\u011b\u0161n\u011b napadena u soudu. A man\u017eel \u010di man\u017eelka p\u016fvodn\u00edho n\u00e1jemce z\u016fstane v nemovitosti bydlet, ani\u017e by kdy s pronaj\u00edmatelem uzav\u0159ela jakoukoliv smlouvu. P\u0159ejdou na ni toti\u017e pr\u00e1va a povinnosti z n\u00e1jemn\u00ed smlouvy uzav\u0159en\u00e9 kdysi s n\u00e1jemcem.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Pron\u00e1jem nemovitosti m\u016f\u017ee m\u00edt ze strany pronaj\u00edmatele i n\u00e1jemce r\u016fzn\u00e1 \u00faskal\u00ed. Ur\u010dit\u011b nen\u00ed n\u00e1jemn\u00ed vztah takov\u00fdm, aby se smlouva nechala podepsat bez odborn\u00e9ho posouzen\u00ed.
